While the idea of a Punisher figure is interesting, a figure based on that character would likely present the potential for copyright issues. Yes, because Damien's avatar is a picture of Damien's custom Punisher minifig based on the character's appearance in a few of the old War Journal comics from the early '90s.
Badger, however, is quite correct. Marvel is very protective of their intellectual property and Will would be treading on dangerous ground if he chose to produce such a minifig for sale. Maybe someday we'll hold a contest to win Damien's custom Punisher. Wonder if there would be any interest in that.

I highly recommend not talking in the third person, as it can cause a lot of problems - just watch Seinfeld. ;)

That's a good one Damien. I love third person. Anyways, is there anyway for Will to somehow get in contact with Marvel and somehow produce one as long as he said that it was Marvel's idea. Sorry, getting a little carried away. *Starts running around trying to think straight.*

Not a chance, sorry.
Currently Hasbro holds the Marvel Toys 'master license' and MegaBloks holds the sub-division 'building toy' license. Marvel would not be at liberty to hand out any kind of agreement with Will without some seriously interesting legal gaming.
Further, there's no chance on this Earth that Marvel would just 'let him do it.' If they even considered giving him legal rights to produce such a minifig, Will would have to pay royalties and a downpayment fee for the rights, same as other companies do. We're talking in the thousands, perhaps tens of thousands of dollars for such rights.
Not going to happen - ever.
