The image you have posted is a custom made by another Lego enthuiasist.

The one main issue I have is that video game-based custom minifigs aren't versatile. Sure, there's always a large fan following, but beyond that, if it's something the general public can't recongnise, it's not worth adapting into a custom minifig. While I am familar with the game, really Payne comes across as just a person in civilian attire who happens to be wielding firearms.
Will's genius can be seen with the WWII Marine Sergeant. I showed a friend of mine a pic and he responded by stating how cute it was and then asking if it was an American Soldier. And this guy hadn't played with Lego much! This shows how easily recongnisable figs can be quickly matched up to the original.
As such, I personally don't think a Max Payne figure should be part of the BrickArms custom minifig lineup.
